1. Acceptance of Terms
By creating an account or using ClearPath Health LLC's ("ClearPath," "we," "us") website or web application (the "Service"), you agree to these Terms of Service. If you don't agree, please don't use the Service.
2. Not a Medical Provider
ClearPath is an AI navigation assistant. It is not a medical provider, does not practice medicine, and does not give medical advice.
Everything ClearPath produces — summaries, explanations, medication reviews, talking points, drafted messages — is informational and intended to help you prepare for and communicate with your actual care team. Always consult a qualified healthcare provider before making any decision about your health, and never rely on ClearPath in a medical emergency. If you are experiencing a medical emergency, call 911 or your local emergency number immediately.
3. Eligibility
You must be at least 18 years old and a resident of the United States to use the Service. By using ClearPath, you represent that you meet these requirements and that all information you provide is accurate.
4. Your Account
You're responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately at support@clearpathhealth.care if you suspect unauthorized access.
5. Subscription & Telephony Charges
The Service is offered as a monthly subscription, currently $9.99/month, billed in advance and auto-renewing until cancelled. You can cancel anytime from your account settings; cancellation takes effect at the end of your current billing period.
Automated calling is billed separately, by the minute, currently at approximately $0.30/minute. You are only charged when you've opted into the calling service and ClearPath places a call on your behalf. Rates are subject to change with notice.
All payments are processed by Stripe. We don't store your full card number.
6. Connecting Third-Party Records
When you connect an EHR system or insurance carrier, you're authorizing that third party to share your records with ClearPath. We display the information those systems provide but don't control its accuracy or completeness — if something looks wrong, confirm it with the source (your provider or insurer) directly.
7. AI-Generated Content
ClearPath uses AI to generate summaries, answers, and drafted content. AI output can be incomplete, outdated, or wrong. You're responsible for reviewing AI-generated content before relying on it or sharing it with your care team.
8. Automated Calling Services
If you opt into ClearPath's calling service, you authorize ClearPath to place calls — using an AI voice agent — to providers and insurers on your behalf, for the purposes you request (e.g., scheduling an appointment or following up on a prior authorization).
Every call opens with a clear statement that it's an automated assistant calling on your behalf, and that the call may be recorded. By enabling this feature, you consent to calls being placed using AI-generated voice technology and to call recording, as permitted by law. You can disable the calling service at any time in Settings; doing so does not affect calls already in progress.
9. Acceptable Use
Don't use the Service to impersonate someone else, submit false health or insurance information, attempt to access another user's data, interfere with the Service's operation, or use it for any unlawful purpose.
10. Intellectual Property
ClearPath and its logos, design, and software are owned by ClearPath Health LLC. Your health records and the content of your conversations remain yours — using the Service doesn't transfer ownership of your information to us.
11. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. CLEARPATH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARPATH'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. CLEARPATH IS NOT LIABLE FOR ANY DECISION MADE ABOUT YOUR HEALTH OR MEDICAL CARE — THOSE DECISIONS REMAIN BETWEEN YOU AND YOUR CARE TEAM.
12. Indemnification
You agree to indemnify ClearPath against claims arising from your violation of these Terms or misuse of the Service.
13. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, Section 11 and any other provisions that by their nature should survive will continue to apply.
14. Dispute Resolution & Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Virginia, and you consent to that venue and jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept them.
